12-yr-old pregnant rape survivor approaches Bombay High Court’s Nagpur Bench for abortion…

A 12-year-old child, who got pregnant after her father’s friend in Chandrapur raped her, approached the Nagpur Bench of Bombay High Court on Wednesday to terminate her 23-week-old (over five months) pregnancy. The accused Yogesh Dohtare was arrested under The Protection of Children from Sexual Offences (POCSO) Act 2012 and Section 376 of the Indian Penal Code.

Justice Vinay Deshpande instructed the dean of Government Medical College and Hospital (GMCH) of Chandrapur to form a panel of five doctors including neurologist, pathologist, gynaecologist, radiologist and a cardiologist to examine the 12-year-old child and submit a report on her pregnancy. The 12-year-old has been asked to obtain necessary orders from the court for her abortion. However, as per the latest development, it has been learnt that there can be a possibility of the child delivering a premature baby during the process of abortion. As per the doctors’ report, inducing delivery with medical methods would best do the abortion. The doctors said that in case the abortion isn’t successful, they would have to resort to hysterectomy (removing the uterus).
