A 12-year-old rape survivor, who earlier approached the Nagpur Bench of Bombay High Court for abortion, on Wednesday morning, gave birth to a premature baby, who died within 10 minutes of being born.
The girl, who hails from Chandrapur, had approached the court on April 8 seeking permission to terminate her 23-week-old (over five months). Justice Vinay Deshpande had then instructed the dean of Government Medical College and Hospital (GMCH) of Chandrapur to form a panel of five doctors to examine the minor and submit a report on her pregnancy. The report by the doctors stated that inducing delivery with medical methods would be the best way to go for an abortion.
However, the girl, who was admitted at GMCH on the day the case was filed, developed complications on Tuesday night and finally delivered a premature baby on Wednesday morning after doctors operated on her. Doctors from GMCH informed through government pleader Sumant Deopujari that the girl is in stable condition. The girl’s counsel Sweety Harish Bhatia has now demanded suitable compensation for the girl and her family to secure her future. The court is expected to hear the case next week.
The girl was sexually exploited by her father’s friend, Yogesh Dohtare, who was later arrested and charged with section 376 of IPC and relevant sections of POCSO (Protection of Children from Sexual Offences) Act.
